Is mediation right for me?

Mediation is still an unconventional and unpopular method of conflict resolution in Bulgaria, and people are hesitant about what exactly it is and whether it is suitable for solving their problem. With this article, we hope to answer these questions as briefly and simply as possible.

Mediation is a method of alternative dispute resolution. What does "alternative" mean - a method that is outside the court system and outside the Arbitration proceedings.

The mediation procedure is conducted by a mediator and the disputing parties. A mediator is a certified person, but is not a judge or arbitrator and does not have to be a lawyer. He is professionally trained to assist and mediate parties in resolving their conflict.

The mediation procedure is usually initiated by one party, with the mediator subsequently undertaking to contact the opposing party to invite it to participate in such a procedure. It is of course possible for the mediation procedure to be initiated simultaneously by both parties.

Regardless of who proposed that the dispute be eventually resolved through mediation, the procedure always begins after the express consent of all parties to participate.

The mediation procedure usually lasts about three hours, which of course depends on the specifics of the dispute.

The mediation process is completely confidential.

A lawyer does not have to be involved. In some commercial disputes, it is recommended, but the involvement of a lawyer in the procedure is entirely at the discretion of the parties.

What disputes are subject to mediation - generally speaking - civil and commercial, namely, but not limited to: Family and family disputes; Ownership and co-ownership disputes; Disputes between neighbors; Disputes between partners; Other civil disputes; Inter-team disputes; Intellectual property disputes?

Mediation is NOT suitable in case of violence between the parties!

Mediation is NOT appropriate when one of the parties completely refuses to cooperate and has agreed to participate in the proceedings without seeking an outcome.

Mediation is NOT appropriate when one party is seeking retribution.

Mediation DOES NOT APPLY to disputes arising from committed crimes.
